What are the exemptions?

Certain EEE is exempt from the scope of the Regulations, in particular:

  • equipment not dependent on electricity to work properly in its basic (primary) function;
  • equipment that is part of another type of equipment which is outside the scope of the Regulations (e.g. an aircraft or car);
  • EEE designed specifically to protect the UK national security or for a military purpose;
  • filament light bulbs;
  • household luminaires for fluorescent lamps;
  • large-scale stationary industrial tools;
  • implanted medical equipment and infected medical equipment.

There is also the possibility that equipment which is part of a 'fixed installation' will be exempt, but this is currently under discussion by the Technical Advisory Committee and it would be unwise to rely upon that for now. The meaning of 'fixed installation' is complex, but further information is available in the Members' Area.
